Johnson & Johnson Group, a maker of pelvic mesh implants, has settled two class actions for USD 300 million after thousands of women worldwide complained of problems with the mesh products, including chronic pain, uncomfortable sex, and incontinence.

This marks the largest product liability class action settlement in Australian history and is pending approval from the federal court.

The net-like meshes, which can take the shape of a “sling,” “tape,” “ribbon,” “mesh,” or “hammock,” are intended to treat pelvic organ prolapse by providing weak pelvic organs with long-term support and to repair damaged tissue.

Johnson & Johnson was accused of failing to adequately evaluate the devices and downplaying their risk to both surgeons and patients in the class actions brought in Australia by Shine Lawyers.

Mesh exposure and erosion, which occur when the mesh pierces the vaginal wall or slashes through internal tissue, vaginal scarring, fistula formation, painful sex, and pelvic, back, and leg problems are among the issues that women experienced. Some of these issues can develop years after surgery and can be challenging to resolve.

The first class action was filed in federal court on October 15, 2012, and it took seven months, from July 2017 to February 2018, to reach a verdict.

A historic ruling in favour of the 1,350 women who participated in the class action who had mesh and tape products implanted to address pelvic prolapse or stress urinary incontinence was handed down in November 2019.

In March 2021, the full court of the federal court dismissed an appeal from Johnson & Johnson Medical and Ethicon.

The principal judge’s finding that the mesh device’s marketing was likely to mislead or deceive was accepted by the full court.

The court dismissed Johnson & Johnson’s legal team’s arguments that manufacturers are exempt from liability with regard to hazards or problems that should be known to doctors or that surgeons and doctors can find out about on their own and warn of.

The court determined that even if not all medical products can be risk-free, patients could expect those products to carry adequate warnings about potential hazards, even if those dangers are unlikely to occur.

The high court rejected Johnson & Johnson Medical’s request for extraordinary leave to appeal in November 2021.

Women who received their implants on or after July 4, 2017, and who were unable to join the first class action, filed the second class action in April 2021.

According to Rebecca Jancauskas of Shine Lawyers, the payment will aid in meeting the women’s ongoing medical needs.

Late in 2021, Johnson & Johnson’s COVID production partner Aspen Pharmacare welcomed the huge licensing contract to manufacture and sell J&J’s single-dose injection in Africa. Five months later, and two months after Aspen began production, the project has run into an issue familiar to all pandemic vaccine makers.

They have not found a single buyer because vaccine distribution in Africa is a lumbering process, leaving many health agencies with a backlog of supplies. According to Bloomberg, Aspen has not got a single order for their branded version of the J&J injection due to a lack of demand — even in Africa, where only 15.9% of its 1.2 billion people have completed a coronavirus vaccine course.

Stavros Nicolaou, Aspen’s head of strategic trade, said that many people in the West and Africa have said that the best approach to fix the situation is to build our local vaccine production capability.

Bloomberg has further quoted that in the fall of 2020, Aspen had signed a partnership agreement with J&J to assist in the development of their coronavirus vaccine candidate. Aspen has started training roughly 500 workers to operate on the COVID vaccination line at its sterile facility in Gqeberha, South Africa, in early 2021.

In March, Aspen came into a lucrative arrangement for its branded version of the shot, Aspenovax. The agreement also granted business pricing and distribution control across Africa.

Nicolaou told Fierce Pharma in late 2021 that the purchase had the potential to be a ‘game-changer’ on two fronts. According to the CEO, an Aspen-branded shot would de facto offer the continent its first COVID-19 vaccine. Second, he believes the agreement will help Africa create local vaccine manufacturing capability. However, commercial production has not begun and is an ominous sign for African countries and vaccine manufacturers.

President of South Africa, Cyril Ramaphosa, speaking at a Pandemic global summit organized by the White House, blamed international agencies for failure to buy vaccines from a pioneering African manufacturer.

Studies have found that 2/3rd of Africans caught a covid infection before the Omicron wave, yet death rates in the continent are the lowest worldwide. Vaccine wait times have also driven down demand, and public health officials are on the verge of abandoning large-scale vaccination drives to focus instead on the most vulnerable groups.

Five top Democratic senators wrote to the CEOs of Pfizer, Moderna, and Johnson & Johnson

Five US senators have called for global access for vaccines developed by Pfizer, Modern as well as Johnson & Johnson, media reports said. Five top democratic senators wrote to chief executives of these medical giants asking them to make their vaccines available globally as Covid-19 cases continue to surge in many parts of the world.

The letter read, “Covid-19 has infected over 148 million people and killed over three million globally, with hundreds of thousands of new cases and thousands of deaths being reported daily.”

Those senators are Elizabeth Warren, Edward J Markey, Tammy Baldwin, Jeffrey A Merkley, and Christopher Murphy. They further said, “Though Pfizer, Moderna, Johnson & Johnson, and other companies have developed safe and effective Covid-19 vaccines, the uncontrolled spread of coronavirus poses significant risks to global vaccination efforts: as the virus proliferates, it is evolves increasing the risk of a variant developing that renders vaccinations ineffective.”

Recently, Covid-19 cases have surged in India. The country has reported more than 300,000 thousand cases each day for the last two weeks. The senators also noted that India, which produces the Oxford/AstraZeneca Covid-19 vaccine, has so far exported more than 66 million doses globally this year.

“Though wealthier countries, including the US, have successfully secured vaccines and have made significant strides in vaccinating their populations, many middle- and lower-income nations have less access to vaccine doses. A recent study estimates that unequal global vaccine distribution could result in a gross domestic product loss of $1.2 trillion annually for the global economy,” the senators added.

Pharamaceutical giant Johnson & Johnson has applied to register a Covid-19 vaccine in South Africa, according to the South African Health Products Regulatory Authority. That makes Johnson & Johnson the first pharamaceutical company in the country to register a Covid-19 vaccine.

It is reported that the government hopes to receive its first vaccine dose from the Covax global vaccine distribution scheme in the second quarter of 2021. The method will include a ‘rolling review approach’ where the evaluation for the vaccine candidate is carried out as data becomes available.

In this context, President Cyril Ramaphosa told the media “It is anticipated that we could have access to a suitable vaccine by the second quarter of 2021 and will initially receive quantities for at least 10 percent of the population. While this gives us hope, the reality is that it will take some time before we can vaccinate enough South Africans to be assured of little to no transmission of the virus, and it will be a costly undertaking. We need to prepare for this, and be ready to make the difficult decisions about where to find the money and when to deploy it.”

The regulator will follow the guidelines set out by the World Health Organisation and work carried out by international counterparts. These include European and US pharmaceutical regulators. The move is an attempt to speed up approvals by avoiding the work that has already been done, media reports said. The first Covid-19 vaccine application is expected to come out in the next one or two weeks.

The Dow Jones briefly topped 23,000 for the first time in its 121-year history on Tuesday.

This happened just two months after they hit the 22,000 milestone.

This year has been full of milestones for the Dow Jones industrial average. The blue-chip stock gauge has rallied more than 3,200 points, gained more than 16% and leapfrogged 20,000, 21,000, 22,000 and 23,000 in 2017.

It was boosted by gains for healthcare firm UnitedHealth and drugs maker Johnson & Johnson, after the companies raised their profit forecasts.

The strong rally has been driven, Wall Street pros say, by a financial rarity: Economies in every corner of the globe picking up at the same time.

The Dow Jones, which tracks 30 of the biggest US listed companies, has hit new records several times over the last month on expectations of strong company profits and hopes that President Trump will win backing for his tax cut plan.

The wider S&P 500 index edged up 1 point to 2,559, while the tech-rich Nasdaq index finished flat at 6,624.

Seven of the 11 major S&P indexes were lower, led by a 0.39 percent drop in industrials and material index .
